Fields of Expertise

In the past, Winner’s Auction House traditionally dealt with Judaica. Following many requests, in 2015, the auction house expanded their field of expertise, and began to hold specialty auctions such as numismatics, ancient maps and more, as well as “Winner’s Unlimited” auctions which contain items from a wide range of areas with no direct connection to Judaism, such as art, art objects, silver and gold vessels, rare books, medals, archeology and more.

The Judaica sales are usually divided into a number of main categories:

Ancient Books and Holy Books – Holy Books from the beginning of the period of the printing press, rare and even single editions, books belonging to Chassidic Rebbes and great Rabbis, first editions of rare books and more.

Manuscripts – As yet unpublished Rabbinic novaelle from prominent Rabbis, Yemenite manuscripts, important Rabbinic letters, poems and prose, personal diaries and more.

Kabbalah and Chassidut – Amulets and segulot, Kabbalistic drawings, rare books of Kabbalah, first editions of books of Chassidut and important writings.

Glosses and Autographs – Of important Rebbes and Rabbis, communal leaders, Prime Ministers such as David Ben Gurion and Menachem Begin, scientists such as Albert Einstein and more.

Rimonim (finnials) for a Torah scroll – Which illustrate the beautify of Jewish craftsmanship among European Jewry, Yemenite Jewry, Moroccan Jewry, American Jewry and Israel.

Silver Items – Breathtaking silver items which illustrate the development of Jewish art throughout the world: North Africa, Europe, Yemenite Jewry, Moroccan Jewry and more. Ritual items such as Kiddush goblets and candlesticks and special items such as cigarette cases, tobacco cases and more.

Scrolls of Esther – Miniatures, on parchment, illustrated and even artistic printings.

Pesach Haggadahs – Unique artistic Haggadahs, extremely rare editions, Kibbutz Haggadahs, Haggadahs from the Holocaust period, and more.

Bezalel Art – Examples from early days of the workshop of ‘Bezalel Jerusalem’, including works of Boris Schatz, Ze’ev Raban, Meir Gur-Aryeh and more.

Zionism – Historical Zionist items such as first attempts of settlements, the First Aliyah, the Jewish Legion, letters and correspondence between Zionist leaders, personal archives, signatures and photographs of Zionist leaders and poets such as Herzl and Leah Goldberg, first editions, banknotes and contracts from the period of the British mandate, Rabbinical letters about the settlement and questions of Jewish law which arose such as the Shemittah Debate and more.

Posters – Historical posters, announcements and advertisements on Jewish topics, such as members of the underground resistance movement, the Jewish National Fund, early Zionism, welcoming ceremonies for Rabbis, funerals of Rebbes, polemics and more.

Calendars – From the first calendars, some of them handwritten (from Yemen and oriental countries, Europe and more) and up until calendars with a historical connection such as Zionist calendars, Jewish National Fund and more.

Maps – Ancient maps of the Land of Israel and Syria, engravings from as early as the 16th century, early journals of journeys to the Holy Land and more.

Catalogs and Auctions

The auctions take place once every two-three months, and are on an international scale, with buyers and sellers from all around the globe. Before every auction, a high-quality catalog is printed which details the items up for sale. The catalogs are uploaded to the website before the auction, in Hebrew and English, to enable customers to examine the items, and even to make offers for them before the auction. During the auction itself there are a number of convenient ways for the customer to participate in the auction: being present in the live auction in order to have the full auction experience, participation from home via the company’s website or via telephone communication with a representative of the company who makes contact in real time.

Method of Sale

The auction house uses the English sale method which is common on the market, in accordance with the terms which appear on the sales contract. When the official catalog is released, a date is fixed for the upcoming auction. Prior to the auction, customers are given the opportunity to bid for an item, no less than the opening price which was fixed in advance. The system saves the price which the customer is prepared to pay, and represents him before his competitors, raising his bid until it reaches the maximum price which he established in advance (if the opening price is $200, and the customer established that he is willing to pay $1,000, the system will offer a bid on his behalf for $200 and will raise his bid until it reaches $1,000; in the event that the competitors go beyond $1,000 the system will stop representing him).

The auction takes place in a location which is fixed in advance and takes place in conjunction, and in a synchronized fashion with the customers on site, on the telephone and on line, and in accordance with the advance bids for each item. During the auction itself, the auctioneer updates the customers of the item’s current price including the advance bids and opens it up to additional competition. The end of the bidding for each item is established by the auctioneer’s hammer blow, and the auctioneer has sole discretion in establishing the winner.

A purchase fee with V.A.T is added to the hammer price, in accordance with the percentages which were established and publicized in advance by the auction house.

Famous Items

Public interest in the special items leads to great competition. Among the more special items which were sold in recent auctions are a unique miniature Torah scroll which belonged to a German merchant hundreds of years ago and was hidden during the Holocaust; a long sermon in the handwriting of Rabbi Yosef Chaim of Baghdad (the Ben Ish Chai); special coins from the Great Revolt and the Bar Kochva Revolt; the stamp of Rabbi Yaakov Emden (the Ya’avetz); coins of Rabbi Shalom Sharabi and works of art from the famous Jewish artist Isidor Kaufmann.

In 2017, Winner’s was in the eye of a media storm regarding the sale of personal belongings of comedian Sefi Rivlin. It comported itself gallantly and returned the items to Rivlin’s family. The subject generated public debate regarding the propriety of selling items of a deceased person without the family’s knowledge and input.

On June 10, 2017 the auction house presented six letters written by renowned Jewish scientist Albert Einstein to his friend David Bohm. The letters included some references to the State of Israel. The letters were sold for over 750,000 ILS, and their sale at Winner’s garnered wide international attention and publicity in hundreds of media outlets around the world.

On October 25, 2017, Winner’s sold another four letters written by Einstein. One letter featured one line that Einstein wrote in 1922 regarding the value of a modest serene life. He wrote the letter in Tokyo and gave it to a bellboy as a tip in the hotel after he was informed that he won the Nobel Prize for Physics. This letter was sold for $1.56 million dollars and triggered wide media coverage in Israel and throughout the world.

3 . עצם ההשתתפות במכירה הפומבית וקבלת “מספר רכישה” מאיתנו מהווה אישור והסכמה כי ידועים למקבל המספר. התקנות, הנוהל, התנאים

והנהוג בתערוכות ובמכירה פומבית שלנו ובכל בעיה וספק, באם יתעוררו, בשעת המכירה או לאחריה, עקב רכישת פריטים מסוימים, ינהג הרוכש או

הרוכשת וכן הנהלת החברה כעורכי המכירה, לפי הנהוג והמקובל אצלנו.

4 . היות והחברה אינה אלא עורכת התערוכה והמכירה ואינה בעלת הפריטים עצמם לכן מוסכם ומותנה בזאת כי בכל מקרה, לא תהיה אחריות החברה כלפי הרוכשים אלא עד העברת הכספים לידי המוכרים- בעלים ולכן, באם הועבר כבר התשלום שהתקבל מהרוכש ליד הבעלים, אזי אף אם תלונתו או טענתו של הרוכש תהיה מוצלחת, אנו נעשה כל מאמץ והשתדלות להשיב את כספו של הבעלים. אך לא תהיה כל התחיבות מצידנו לכך, וכן לא ננהל הליכים משפטיים לשם החזרת כספים לרוכשים לאחר שהועברו לבעלים. אולם נסכים למתן האישורים המתאימים מצידנו לרוכש כדי שיוכל לנהל הליכים משפטיים נגד הבעלים.

5 . עם קבלת “מספר רכישה” מאיתנו באופן אישי או טלפוני, מסכים ומתחייב הרוכש לא לתבוע באופן אישי או בתביעה משפטית בכל מקרה של נזק או טעות בתיאורי הפריטים את החברה. כל טענה או תביעה לאחר העברת הכספים לבעלים הנה אך ורק כלפי הבעלים.

מחירים והערכות:

ההשתתפות במכירה מתבצעת באחת מהאפשריות הבאות: א. ע”י הופעת הרוכש\ת בעצמו באולם ב. בא כוחו ג. ע”י הצעות טלפוניות או בכתב, המייפות את כוחה של הנהלת החברה לרכוש עבור המזמינים פריטים שונים ד. דרך האינטרנט.

6 . משתתף המופיע כבא כוחו של אדם אחר, מחייב את עצמו ואת שולחו באותה מידה, ויחויב לעמוד בעצמו בתשלומי רכישותיו עבור משלחו ואנו נראה בו כ”רוכש” לכל דבר, ונוכל לפנות אליו או אל שולחו כדי לממן את הרכישה, לפי ראות עינינו.

7 . באם נקבל הזמנה טלפונית או בכתב לפריט מסוים, נשתדל לפעול למען האינטרס של המזמין כאילו היה הוא בעצמו באולם. אולם, אין התחיבות מצידנו להשיג עבורו את הפריט.

8 . אין התחיבות לקבל כל הצעה שהיא לרבות הגבוהה ביותר וזאת אף אם הרוכש או מיופה כוחו נמצא באולם ומשתתף אישית במכירה.

9 . המכירה עצמה מנוהלת בהכרזת דולרים של ארה”ב. אולם התשלום בפועל מתקבל בשקלים לפי חישוב הדולר בשער אשר יוכרז עליו בפתיחת המכירה או ביום התשלום (הגבוה מבינהם), או בדולרים של ארה”ב.

10 . א. על כל תשלומי הרוכשים עד $500,000 לפריט מתווספים 24% עמלה. מעל $501,000 לפריט מתווספים 20%. על כל התשלומים יש תוספת מע”מ על העמלה. תוספות אלו הינם חלק בלתי נפרד מהצעת המחיר המתקבל ע”י מנהל המכירה בשעת המכירה וכל ההתחייבות והמשתמע מהן חלות גם על האחוזים.

ב. תושב חו”ל יהא זכאי לפטור מן המע”מ רק במידה והפריט שרכש ישלח לחו”ל ע”י החברה ללא אחריותה ובכפוף להוצאת רשימון יצוא משרותי המכס. הרוכש ישא בכל העלויות הנילוות.

11 . א. צ’יקים בנקאיים או צ’יקים אישיים מתקבלים בהסתייגות עד לביצוע התשלום בפועל ע”י הבנק.

ב. תשלום במזומן, בצ’קים או בהעברה בנקאית מהארץ הם ללא עמלה. תשלום בצ’קים )מחו”ל( או כרטיסי אשראי )מהארץ( יחויבו בתוספת של 1.5% .

העברה בנקאית מחוץ לארץ תחויב בתוספת של 1.5% מהסכום, מינימום 30$ . תשלום בכרטיסי אשראי מחו”ל יחויב בעמלה של 3% . כל החיובים הנ”ל אינם תלויים בתאריך הגביה וכפופים להיתר עיסקה.

2 1 . ליד כל פריט נמצאת הערכת המומחים שלנו. נא להתייחס אל ההערכה רק כאל הצעה בלבד, אין כל הבטחה שהפריטים לא ימכרו מתחת למחיר הנמוך המופיע בהערכה ואין כל בטחון שהמחיר לא יעלה ואפילו בהרבה על המחיר הגבוה. סעיף זה אינו גורע מהגנתנו העקבית על מחיר המינימום של בעל הפריט, הגנה זו מתבצעת על ידינו בדרכים מקובלות והנראות לנו. לצורך זה נרשם גם מחיר הפתיחה ליד הערכה.

פעמים ואנו מקבלים פריטים אשר הבעלים קבעו להם מחיר פתיחה נמוך ביותר, אנו מצידנו קובעים את ההערכה מבחינה מקצועית, לכן אנו רושמים את מחיר הפתיחה, המבוקש ע”י הבעלים אך רושמים גם את ההערכה שלנו, שהיא לפעמים גבוהה בהרבה ממחיר הפתיחה.

13 . הרוכש (לרבות אדם שרכש את הפריטים שלו שהוא העמיד למכירה) או בא כוחו יוציא את הפריט שנרכש בהקדם האפשרי. אנו מבקשים להופיע תוך 7 ימים, לשלם ולהוציא את הפריטים ומכל מקום בשום אופן לא לאחר יותר מ- 14 יום. כעבור 14 יום החברה תשמור לעצמה את הזכות לגבות 5$ לפריט ליום, דמי שמירה ואחסון ו/או לבטל את המקח בצורה חד צדדית, בלי לוותר על זכות התביעה של העמלות.

14 . משלוח הפריטים אל בית הרוכש, מתבצע על אחריותו הבלעדית, ובדרך שתיראה לנו. כל הוצאות משלוח וכו’ על חשבון הרוכש.

15 . הרוכש ישלם על רכישותיו לפני הוצאת הפריטים ממשרדי החברה.

16 . לידיעת הבעלים: אין אנו אחראים לביצוע בפועל של התשלומים אשר התחייבו הרוכשים לשלם בשעת המכירה. כל התחיבות של הרוכשים אשר לא תבוצע בפועל, ניתן את כל הגיבוי לבעל הפריט ]לשעבר[ לגבות את התשלומים המגיעים לו. אך לא ננהל בפועל הליכים משפטיים כנגד רוכשים,

אלא נשתדל בכל הדרכים הנראות לנו כגון עיקול כספים של רוכשים באם נמצאים אצלנו, או חפצים שלהם וכדומה, אך איננו מתחייבים לעקל כספים וכדומה.

17 . למרות כל האמור מסכימים הרוכשים והמוכרים לראות בנו כצד משפטי לכל דבר במקרה ונעמוד על זכותנו הניתנת לנו בזה, לנהל הליכים משפטיים ולנקוט בכל דרך מקובלת אחרת כנגד צד שאינו עומד באיזהו שהיא מהתחייבויותיו.

18 . אנו משאירים לעצמנו את הזכות להודיע בע”פ או בכתב, עד שעות המכירה, על שינויים בסעיפים דלעיל או הוספת שונות באם יהיו כאלו.

19 . בכל מקרה של שינוי, תוספת או השמטה בתרגום לאנגלית, הנוסח העברי קובע.

A GUIDE TO THE PARTICIPANTS IN THE EXHIBITION AND PUBLIC AUCTION REGULATUON AND PROCEDURES
 Winner’s Auction LTD (the company) – is hereby holding an exhibition in Judaica, to enable the public to examine these
important items, with the possibility of purchasing them at an auction sale to be held at the conclusion of the exhibition. For the convenience
of the public, we have published a detailed catalogue with photographs and descriptions for each item. Catalouge description are based on
the opinions of our experts. However, the sole responsibility of the buyer to inspect each lot. Please regard the catalogue as your personal
guide to the exhibition and auction. Our staff will be at your assistance throughout the exhibition and auction.
Administration of the auction and conditions of Auction:
The auction itself will be directed by an experienced auctioneer according to the standards and regulations of auction houses. We request
visitors and participants to familiarize themselves with the regulations and current conditions. We recommend that people unfamiliar with
these regulations ask our staff at the exhibition for the information they deem necessary.
* Participation in the public auction and receipt of a “participant’s number” are tantamount to the confirming and agreeing that the
recipient of the number is familiar with the regulations, procedures, and conditions of our exhibitions and public sales. Any problems
arising during the auction sale or afterwards as a result of a purchase will be resolved by the purchaser and the management of the company
in according with accepted practice.
* Since the company is merely the organizer and administrator of the exhibition and auction, and is not the owner of the items themselves,
it is hereby agreed and stipulated that in no case will the Company be responsible to the purchasers after the transfer of the payment to the
seller- owners. Thus, in case the payment received from a purchaser has already been transferred to the owner, and even if the complaint
or claim made by the purchaser is justified, and we make every effort to have his money retuned to him by the owner, we shall be under
no obligations to do so, and shall not engage in any legal proceedings after it has been handed over to the owner, though we shall agree
to provide the purchaser with suitable documentations on our part to enable him to engage in such legal proceedings against the owner.
* Upon receipt of the “participant’s number”, in person or via telephone, the potential buyer agrees and obligates himself not to prosecute
us or place a lawsuit against us in the event of damage caused or error in the catalogue description. Any complaints or claim after transfer
of the money to the seller, are only valid against the seller himself.
Prices and Estimates:
Participations in the auction is expressed: (a) by the personal presence of the purchaser in the hall; (b) by the presence of his representative;
(c) by means of written or telephoned bids empowering the management of the company to purchase various items for the person ordering
them (d) Via the Internet.
* The presence of the purchaser’s representative obliges him to make good his purchases, with whatever this entails. The company shall
not agree to obligate his sender or to free the representative of any obligation, even though the representative may fill his sender’s name
explicitly in our forms.
* If we receive a telephone or written order for a certain item, we shall strive to act in the interest of the person giving the order, just as if
he himself was in the hall. We, however, are under no obligation to obtain the item for him.
* We are under no obligation to accept any bid, including the highest bid, even though the purchaser or his representative is personally
present in the hall and participating in the auction.
* The auction itself is administered by announcing numbers in US$, though the actual payment may be made in either Shekalim in
accordance with the average rate of exchange which will be announced at the auction hall or at the day of the payment (The highest) or in USD.
* A 24% commission charge is added to all payment made by purchasers up to $500,000. 20% is added up to $501,000. A Vat ia added only on this comission charges. This percentage is an integral part of the bid accepted by the auctioneer during
the auction, and all obligations, etc, apply also to this percentage
* A foreign resident will be exempt from VAT only if the item purchased is shipped outside of the country by the company without its
guarantee and subject to receipt of an export entry from the custom authorities. The purchaser will cover all related expenses.
* Bank and personal checks are accepted tentatively, until they are honored by the bank.
* Payment by cash, checks or transfers within the country will be accepted without further charge. Foreign checks, credit cards (from
Israel) will be charged an additional 1.5%. bank transfers from foreign countries will be charged an additional 1.5% min. $30. Credit card
payments from foreign countries will be charged an additional 3%.
* Each item is accompanied by an estimate value made by our experts. There is no guarantee that the item will not be sold for a lower

* ATTENTION OWNERS: The company is not responsible for the actual carrying- out of payments undertaken by the purchasers during
the auction. In the event that obligations by the purchaser are not honored, we shall support the former owner of the item is taking steps
to obtain the payment owing him, but we shall not engage in legal procedures against purchasers. We shall proceed in all ways we find
suitable, but we are under no obligations to do so.
